Numu Baby is a brand marketed by PFS, Lda.

These Terms and Conditions govern the use of the website and purchases made through the Numu Baby online store.

2. Scope

By using this website or placing an order, the user accepts these Terms and Conditions.

Purchases must be made by persons who have the legal capacity to enter into contracts. Minors must act through or with the authorisation of their legal representatives.

3. Products

Numu Baby endeavours to provide clear and accurate information regarding the characteristics, images, dimensions, materials and other information relating to its products.

Product photographs are for illustrative purposes and slight differences in colour or appearance may occur due to the device used to view the website or production changes that do not alter the essential characteristics of the product.

If a material error is identified in the description or information relating to a product, it will be corrected as soon as possible.

4. Prices

Prices displayed in the online store are stated in euros (€) and include VAT at the applicable legal rate, unless expressly stated otherwise.

Shipping costs and any other additional charges applicable to the order are displayed to the customer before the purchase is completed.

Numu Baby may change its prices at any time. Such changes will not affect orders that have already been completed and confirmed, except in the case of an obvious error where permitted by law.

5. Orders

Placing an order involves selecting the products, providing the information required for purchase and delivery, selecting the shipping and payment methods and finally confirming the order.

Before completing the purchase, the customer will have the opportunity to review and correct the information entered.

Once the order has been submitted, a confirmation will be sent to the email address provided by the customer.

6. Availability

All orders are subject to product availability.

If, after an order has been placed, a product is found to be unavailable, the customer will be informed as soon as possible.

Where applicable, an alternative may be proposed or the amount paid for the unavailable product will be refunded.

7. Payment

The payment methods currently available are displayed during checkout.

Customers must only use payment methods that they are legally authorised to use.

The order will be processed in accordance with the conditions associated with the selected payment method.

8. Shipping and Delivery

Delivery conditions, costs and estimated delivery times are set out on the Shipping, Returns and Legal Guaranteepage.

The customer is responsible for providing a correct and complete delivery address.

Delivery times are estimates, without prejudice to maximum statutory delivery periods or any other rights provided for under applicable law.

9. Right of Withdrawal and Returns

For purchases made at a distance, consumers benefit from the statutory right of withdrawal.

Numu Baby allows customers to notify their intention to return a product within 15 days of receiving the order, representing an extension of the statutory minimum period of 14 days.

The applicable conditions and procedure are set out in detail on the Shipping, Returns and Legal Guarantee page.

Exercising this right is not subject to the payment of any penalty.

10. Legal Guarantee and Product Conformity

Products sold by Numu Baby benefit from the rights relating to the conformity of goods and the statutory guarantee provided for under applicable legislation.

For new movable goods, the current statutory liability period for lack of conformity is 3 years following delivery, without prejudice to any special statutory regimes that may apply.

11. Order Cancellation

If the customer wishes to cancel an order before it is dispatched, they should contact Numu Baby at hello@numubaby.com as soon as possible.

If the order has not yet been dispatched, Numu Baby will seek to stop its processing.

The operational inability to cancel an order that has already been dispatched does not affect any statutory right of withdrawal available to the consumer.

12. Liability

Numu Baby endeavours to ensure the availability and proper operation of the website but cannot guarantee completely uninterrupted or error-free use.

Nothing in these Terms and Conditions excludes or limits consumer rights or liabilities that cannot legally be excluded or limited.

13. Intellectual Property

Unless otherwise stated, the content available on this website, including text, images, photographs, trademarks, logos, graphic elements, videos and other content, belongs to Numu Baby/PFS, Lda. or is used with the authorisation of the respective rights holders.

Its reproduction, distribution, modification or commercial use without prior authorisation is not permitted, except where allowed by law.

17. Applicable Law

These Terms and Conditions are governed by Portuguese law, without prejudice to any mandatory consumer protection provisions that may apply.

Where the consumer resides in another Member State of the European Union, this provision does not affect any protection afforded by mandatory provisions of the law of the consumer's country of residence, where applicable.

18. Amendments

Numu Baby may update these Terms and Conditions whenever necessary.

Changes take effect upon publication and do not affect rights relating to orders entered into before the changes were published.
